Terms & Conditions

By accessing or purchasing from this website, you agree to the following Terms and Conditions. Please read them carefully prior to completing your purchase.

1. Intellectual Property & Copyright Notice

All artwork, original paintings, custom commissions, fine art prints, and reproductions (current or future) remain the sole intellectual property of Ishi Wild.

Ownership vs. Copyright: Purchasing any item - original or otherwise - transfers physical ownership of that specific product only. It does not transfer copyright, license, or distribution rights.

Prohibited Uses: You may not mint any piece into an NFT, scan, reproduce, print, distribute, or otherwise exploit the artwork in any form for profit or non-profit purposes without express written permission from the artist.

Social Media: Posting photos of your purchased artwork on personal social media accounts is always welcome and does not breach this clause.

2. Product Descriptions, Calibration & Quality Control

Every print is inspected multiple times before clearing quality control, ensuring only pristine reproductions are packaged for shipping.

Customer Responsibility: Customers must read product descriptions thoroughly and carefully before placing an order. We are not responsible for compensating customers who fail to read the listing details prior to purchase.

Print Borders: All fine art prints include white borders, which are calculated into the final dimensions stated in the product listing.

Display Calibration: We make every reasonable effort to display artwork colors accurately. However, colors may vary between screens due to differences in monitor, device, and display calibrations. These variations do not constitute a defect or fault. Customers concerned about color accuracy are encouraged to view product images across multiple devices before purchasing.

3. Shipping & Dispatch Policy

Estimated processing and dispatch timeframes are provided within each product description.

Peak Processing Times: While we endeavour to dispatch all orders promptly, processing times may occasionally be extended during periods of exceptionally high demand, such as sales events, product launches, or holiday periods.

Address Amendments: You are responsible for ensuring that all shipping details provided at checkout are accurate, complete, and current. Requests to amend a delivery address must be submitted within 24 hours of purchase. While we will make reasonable efforts to accommodate changes within this window, updates cannot be guaranteed once order processing has commenced.

Undeliverable Packages & Dispatched Orders: Once an order is dispatched, we cannot alter the delivery address and accept no liability for parcels delayed, lost, misdirected, or returned due to incorrect details provided by the customer.

Reshipment Fees: If an order is returned to the studio due to an incorrect or undeliverable address, you will be responsible for any additional shipping costs incurred to resend the package.

Returned Order Cancellations: If you elect to cancel an order after it has been returned to the studio due to delivery failure, your refund will exclude all original shipping and handling costs. Where permitted by law, a fee representing administrative, packaging, and restocking costs (or diminished value) may be deducted from the final refund amount.

4. International Orders, Duties & Import Taxes

The studio operates in the United Kingdom and is not liable for import fees on any products purchased (including custom commissions, original paintings, and fine art merchandise).

Customs Charges: For orders shipped outside the UK, applicable taxes, duties, and customs clearance fees are not included in the checkout total. These fees are set by the destination country's customs agency, which will contact you directly for payment before delivery.

Customer Responsibility: Paying all duties, VAT, or local taxes is the sole responsibility of the customer.

Refused Deliveries: If you refuse to pay these additional charges, your package will be returned to us. Provided the item arrives back in its original condition, we will issue a refund for the purchase price minus all outbound and return transit costs.

Export Documentation: All items are declared at their true purchase value for export. Under no circumstances will customs documents be falsified.

5. Right to Cancel ("Cooling-Off" Period)

In accordance with the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK customers purchasing online are entitled to cancel their order within 14 days of receiving the goods without giving a reason. Customers residing in the European Union or other jurisdictions may have equivalent rights under local consumer laws where applicable.

Exemptions: The right of cancellation does not apply to custom commissions, bespoke goods, personalised items, or any other products exempt under applicable consumer legislation.

Notification & Returns: To exercise this right, you must notify Ishi Wild of your intention to cancel within the 14-day window. Returned goods must be sent back promptly in their original, saleable condition.

Return Shipping Costs: Except where required by law, the customer is solely responsible for all costs associated with returning goods, including postage, tracking, insurance, customs duties, taxes, and related fees.

Diminished Value & Inspection: Customers are liable for any diminished value of the goods resulting from handling beyond what is reasonably necessary to establish their nature, characteristics, and functioning.

Condition of Fine Art Returns: Due to the delicate nature of fine art, returned items must show no evidence of damage, excessive handling, wear, creasing, folded corners, tears, scratches, staining, mounting, framing, or alteration. Deteriorated returns may result in an appropriate refund deduction or the complete refusal of the return request.

Refund Processing: Once an accepted return is received and inspected, refunds will be processed in accordance with applicable statutory timeframes.

6. Liability, Returns & Damaged Goods

We are not liable for goods once they are delivered into the possession of the collector. It is not our duty to refund, exchange, replace, or compensate for damage to products caused by customer mishandling (such as smudging fingerprints on white borders, tearing fine art prints, or improper unpacking/framing).

Statutory Damage Protections: As guaranteed under UK consumer protection laws (including the Consumer Rights Act 2015), remedies are due if products are received damaged as a result of transit handling, or where faulty or incorrect merchandise has been dispatched.

Resolution Process: If an item arrives damaged, defective, or incorrect, please contact the studio promptly with clear photographs of the product, outer packaging, and details of the issue so we can work with you in good faith to arrange an appropriate resolution.

Evidence Requirements: All shipments include a packing invoice identifying parcel contents. To verify claims for replacements, refunds, or missing items, you may be required to provide a photograph of the included packing invoice alongside photos of all received contents. Failure to supply requested evidence may affect the assessment of your claim.

Return Shipping Exclusions: Return shipping costs will only be covered by Ishi Wild where an item is determined to be faulty, damaged in transit prior to delivery, incorrectly supplied, or where otherwise required by law.

Promotional Items: Any complimentary gifts, test prints, or misprints included with an order are provided at the studio's discretion, carry zero monetary value, and are strictly excluded from replacement, exchange, refund, or statutory guarantee obligations unless required by law.
